“We take the mystery out of, ‘Was anything done since the storm? Did a flood affect the property or not?’” King explained, with a tone that suggested a blend of relief and responsibility. Currently, homeowners aren’t required to disclose previous flood damage. Following the calamity of Hurricane Ian, which left deep impressions on Fort Myers Beach, a “Hurricane Ian Disclosure” form was devised by realtors to alert potential buyers of previous flood-related issues. King noted, “Even today, that form still applies to homes that have undergone renovations after being affected by floodwaters.”

However, with the implementation of the new law, sellers will now be obligated to disclose any flood-related insurance claims or federal assistance received, along with the grim reality that standard home insurance policies typically do not cover flood damage. The unvarnished truth is what buyers need to understand, allowing them to feel secure amidst the uncertainties of homeownership.

“It’s all critical for the buyers to grasp these elements so they can feel safe – so they can trust the process,” King remarked, embodying the dual role of advocate and educator.

After all, Fort Myers Beach isn’t alone in facing these challenges. The law also serves buyers in more inland areas, where the risk of flooding may be less visible but is no less potent. “You don’t see many hurricane-damaged homes anymore – they’ve all been spruced up and repaired. Yet, the past remains; it must be disclosed ethically,” he maintained, his wisdom underscored by experience.
